there's not much that can be done at tex-live, if you provide a test case
to the l3 repository github we could check if any change is intentional
I notice
\documentclass{article}
\usepackage{index}
\begin{document}
a
\end{document}
produces a warning
LaTeX Warning: Command \markboth has changed.
Check if current package is valid.
LaTeX Warning: Command \markright has changed.
Check if current package is valid.
which is due to some internal changes in the mark commands meaning a patch
doesn't match but that's unrelated to the l3 backend
what error are you seeing?
