[tex-live] behaviour of kpsewhich on case-insensitive mac system

I should add something I see rather frequently;

    \usepackage[Francais]{babel}

which is accepted on Windows, but of course breaks on case sensitive systems. Or

    \documentclass[ieeetran}

and

    \bibliographystyle{ieeetran}

where it should be IEEEtran in order to be compatible across systems.

I understand that TeX Live/Windows likes/needs to be compatible with MiKTeX; 
were it for me, I’d not allow it.
