Sorry, but I am unable to follow you.

What I have in mind is to _optionally_ (if the administrator wants) configure the system so that it finds stuff at the top (root) of the home tree, *as well as* in the subdirectories. 

That is, it would find *both*:
TEXMFHOME/tex/mypack.cls (as it does now)
but also
TEXMFHOME/mypack.cls
Those who have a large TEXMFHOME with the recommended subdirectory structure would see NO change in functionality whatsoever... their stuff would be found in the usual way, as now.

On the other hand, those who won't bother with subdirectories (b/c they only have a few items in TEXMFHOME or for any other reason, valid or not) would also have their stuff found.

Of course the system administrator could still choose not to allow  the system to search the top of TEXMFHOME if for some reason s/he thinks that is better. 

I see no one losing.
